1.Overview
These Terms of Service (the "Terms") govern your access to and use of the Tender Fraud Prevention platform operated by Tender Fraud Prevention (c) 2026 ("Tender Fraud Prevention", "we", "us").
By creating an account, submitting an email for verification, or otherwise using the platform, you agree to be bound by these Terms.
2.Definitions
- Platform — the Tender Fraud Prevention web application, APIs, and related services.
- Verification — an automated analysis of an email or attachment for fraud indicators.
- Report — a user-submitted fraud disclosure reviewed internally by our intelligence team.
- Subscriber — an organisation or individual on a paid plan.
- POPIA — the Protection of Personal Information Act, 4 of 2013.
3.Eligibility
You must be at least 18 years old and either acting in your individual capacity or on behalf of an organisation with authority to bind it. The platform is intended for use within the Republic of South Africa; use from other jurisdictions is at your own risk regarding local law.
Paid plans are offered exclusively to small and medium enterprises (SMMEs) and other private businesses. Government departments, state-owned entities, municipal bodies, and individuals acting in an official capacity on behalf of any of the foregoing are not eligible to purchase a paid plan. Free anonymous verification remains available to any visitor, including individuals reporting suspected fraud from a government email address.
4.Account registration
You provide accurate information when registering and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately if you suspect unauthorised access.
5.Acceptable use
You must not:
- Submit content you do not have a lawful right to submit;
- Use the platform to harass, defame, or unlawfully target any person;
- Attempt to circumvent rate limits, authentication, or access controls;
- Reverse-engineer, scrape, or republish our intelligence outputs without licence;
- Use automated submissions that exceed your plan's API quotas;
- Use the platform to mass-test or train a competing AI system;
- Submit content containing malware or active exploit payloads except via the secure forensic endpoint;
- Misrepresent a verification outcome to a third party.
6.Subscription & billing
Paid plans are billed monthly or annually in advance. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are pro-rated where required by South African consumer protection law and otherwise discretionary.
Price changes apply from your next renewal and we will notify you at least 30 days in advance.
7.Data & privacy (POPIA)
We process your personal information in accordance with POPIA and the Tender Fraud Prevention Privacy Policy. We never sell your data. We never store the content body of submitted emails; only metadata used for aggregate threat intelligence (retained for 30 days).
Audit logs are retained for 7 years (POPIA s.53). You may request access, correction, or deletion of your personal information via the DSAR page.
8.Intellectual property
All platform code, design, documentation, and intelligence outputs are owned by Tender Fraud Prevention. You receive a non-exclusive licence to use the platform for the duration of your subscription. You retain rights to your submitted content — we acquire only the licence necessary to provide the service.
9.Third-party services
The platform relies on third-party sub-processors in the categories below. Each is engaged under a data-processing agreement with appropriate cross-border safeguards; the specific providers are not disclosed.
- Cloud infrastructure — database, authentication, server functions.
- AI analysis — phishing & fraud pattern detection.
- Email delivery — transactional email dispatch.
- Error monitoring — application error and performance monitoring.
10.Indemnity & limitation of liability
Final fraud determination lies with the end-user and the relevant authorities.
Tender Fraud Prevention outputs are risk indicators, not legal determinations. You are responsible for escalating suspected fraud to SAPS, SAFPS, the Hawks, and the Asset Forfeiture Unit as applicable. Our maximum aggregate liability is capped at 12 months of subscription fees actually paid by you.
11.Termination
You may cancel your subscription at any time from the billing page; access remains until the end of the paid period. We may suspend or terminate accounts that breach these Terms, are inactive for more than 24 months, or pose a security risk to other users.
12.Governing law
These Terms are governed by the law of the Republic of South Africa. The parties submit to the exclusive jurisdiction of the High Court of South Africa, Johannesburg Local Division, for any dispute that cannot be resolved through the process in clause 13.
13.Dispute resolution
Disputes must first be raised in writing via our contact form. The parties will attempt to resolve the matter through good-faith negotiation for 30 days before either party may approach a court or initiate mediation through the Arbitration Foundation of Southern Africa.
14.Changes to these Terms
We may revise these Terms from time to time. Material changes will be announced via in-app notification and email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
